Understanding No-Fault Divorce

Virginia allows a couple to get
divorced if they they have lived separate and apart for a certain period of time and have lived in Virginia for at least six months. If a couple has minor children together, they must wait at least 12 months from their date of separation to file for divorce. A married couple who does not have children together, or whose children are over the age of 18 may file for divorce after having lived separate and apart for six months if they have a separation or property settlement agreement.
