Understanding No-Fault Uncontested Divorce

Virginia allows a couple to get
divorced if they they have lived separate and apart for a certain period of time and have lived in Virginia for at least six months. If a couple has minor children together, they must wait at least 12 months from their date of separation to file for a no fault uncontested divorce. A married couple who does not have children together, or whose children are over the age of 18 may file for a no fault uncontested divorce after having lived separate and apart for six months if they have a separation or property settlement agreement.
